About this Financial Services Guide

In this Financial Services Guide (FSG), when the terms 'we', 'our' or 'us' are used, it means 360 Capital FM Limited ABN 15 090 664 396 (AFS Licence Number 221 474) and/or its related bodies corporate (as the context requires) unless otherwise stated.

360 Capital FM Limited is a public company, wholly owned by the ASX listed 360 Capital Group (ASX: TGP) which is comprised of the 360 Capital Group Limited ACN 113 569 136 and the 360 Capital Investment Trust ARSN 104 552 598 (360 Capital Group).

Purpose of this Financial Service Guide

This FSG is designed to assist you in deciding whether to use any of the products and services offered by us.

This FSG will provide you with information about us and how we can be contacted; what financial services we are authorised to provide to you; how we are remunerated; how we manage conflicts of interest; how we protect your information; and how we manage complaints.

Financial services we offer

We are authorised by our Australian Financial Services Licence (No. 221 474) to provide the following services:

     1) General financial product advice to wholesale and retail clients in respect of the following financial products:

          a) interests in managed investment schemes (other than investor directed portfolio services (IDPS)),
          b) securities, and

     2) Dealing services to wholesale and retail clients including:

          a) issuing, applying for, acquiring, varying or disposing of financial products being:
                 i) derivatives; and
                 ii) interests in managed investment schemes; and
                 iii) securities;
          b) applying for, acquiring, varying or disposing of financial products on behalf of another person being:
                 i) deposit and payment products;
                 ii) derivatives;
                 iii) general insurance products;
                 iv) debentures, stocks or bonds;
                 v) interests in managed investment schemes; and
                 vi) securities;
          c) underwriting:
                 i) interests in managed investment schemes;
                 ii) an issue of securities;

     3) Operating registered managed investment schemes for wholesale and retail clients which hold the following types of property:

          a) financial assets;
          b) direct real property; and
          c) mortgages via the ‘Dealt Trust’ scheme.
 
We are also authorised to operate custodial or depository services (other than IDPS).
 
General advice
If you visit our website or contact any member of our investor enquiries team or the wider 360 Capital Group you will receive factual information or general advice only.
It is important to note that general advice does not take into account your personal objectives, financial situation or needs. Advice we provide is general in nature and is provided to enable you to assess your own circumstances against products you wish to invest in.

You should consider the appropriateness of any such general advice having regard to your own objectives, financial situation and needs before you act on that general advice. Where the general advice relates to the acquisition or possible acquisition of a financial product, you should also obtain an offer document relating to the financial product and consider that document before making any decision about whether to acquire the financial product.

We do not generally provide advice about financial products issued by entities that are not related to us, except to the extent of advising you of how the features of 360 Capital Group’s products may compare to other products.
 
Offer document
If you would like to invest in any product from the 360 Capital Group, we will provide you with a copy of the relevant offer document or you can request an electronic copy from our website.

The offer document will contain information about the features, costs, risks and benefits of the relevant financial product that you are considering investing in.
 
Insurance arrangements
We have professional indemnity insurance, provided through our parent entity 360 Capital Group, that satisfies the requirements under s912B of the Corporations Act 2001 for compensation arrangements.
 
How we are paid for the services we provide
We are remunerated directly through the fees applicable to the products in which you invest.
 
We do not charge you directly for any services or assistance we may provide to you.

Fees relating to a product, including any fees payable to third party advisers, will be detailed in the relevant offer document.

Employees of the 360 Capital Group are remunerated by way of salary and bonuses linked to their employment and performance. Employees may also participate in the 360 Capital Group employee share scheme, details of which can be found here https://www.360capital.com.au/tgp-investor-centre
 
360 Capital Group employees do not receive commissions.
 
Payments to third parties
We may make payments or provide other benefits to third parties for referring customers to us. This is not a cost to you—we pay this personally. We may negotiate a rebate of part of the management fee or charge a lower management fee with investors who are wholesale clients for the purposes of the Corporations Act or with 360 Capital Group staff.
 
Related party transactions
We may provide investment management services and products, investment advisory services, fund and portfolio services or act as responsible entity, trustee or investment manager for companies or funds in the 360 Capital Group. We may receive fees, charges or other benefits for acting in these capacities.

Where we enter into transactions with related parties, we operate in accordance with the related party protocols and 360 Capital Group policies and procedures which require us to transact on terms that would be reasonable if the parties were dealing at arm’s length.
 
Your privacy
At 360 Capital Group, the privacy of your personal information is important to us. Any personal information we collect will be handled in accordance with our Privacy Policy. Our Privacy Policy details how we comply with the requirements of the Privacy Act 1988 (Cth) in the handling of your personal information. What to do if you have a complaint about our services
As the holder of an Australian Financial Services Licence, we are required to have a system for handling complaints from persons to whom we provide financial services.

If an issue has not been resolved to your satisfaction, you can lodge a complaint with the Australian Financial Complaints Authority (AFCA). AFCA provides an independent financial services complaint resolution that is free to consumers.
